Local Law 31, enacted on August 9, 2020, requires that building owners use a certified inspection agency to test for lead-based paint.
Building owners must test all apartments for lead paint by August 2025, or within one year of a child age 5 or younger coming to live or spend at least 10 hours per week in an apartment.
If the NYC Department of Housing Preservation and Development finds a lead paint hazard, the building owner will receive a violation and be required to fix the hazard within a specified amount of time.
Lead-based paint fines could be $250 per day, per violation– up to a maximum of $10,000.
